These terms cover what you can do with what you find here, what this content is and isn’t, and where we stand if something goes wrong. Plain English, no surprises.

Agreement to these terms

paulswaney.com (the “site”) is operated by Paul W. Swaney III and Swaney Group Capital (“we”, “us”), based in St. Petersburg, Florida. By using the site you agree to these terms. If you do not agree with them, please do not use the site.

These terms work alongside our Privacy Policy, which explains how personal information is handled.

Using the site

You may read, print and share the content here for your own personal or internal business use. In return, please do not:

  • republish, resell or redistribute the content as your own, or for commercial gain;
  • scrape, crawl or bulk-download the site, or use it to train a model, without written permission;
  • attempt to gain unauthorized access to the site, its database or its administrative areas, or interfere with its operation;
  • use the contact form or newsletter to send spam, malware or unlawful material.

We may suspend or block access to the site if it is being misused, and we may change, suspend or discontinue any part of it at any time.

The content is information, not advice

Everything on this site — articles, keynote descriptions, podcast episodes, case studies and the newsletter — is published for general information and education. Intellectual property

The site and its content — text, photography, illustrations, video, audio, design, code, the “Paul W. Swaney III” and “LeverUp” names and associated marks — are owned by Paul W. Swaney III or Swaney Group Capital, or used with permission, and are protected by copyright and trademark law.

Short quotations with clear attribution and a link back are welcome. Anything more — reproducing an article in full, using photography or brand assets, or licensing content for a publication, event or product — needs written permission first. Email Info@swaneygroup.com.

Third-party logos and names appearing on the site remain the property of their respective owners and are shown to identify past work and affiliations, not to imply endorsement.

Newsletter and email

Subscribing to the newsletter means you agree to receive email from us at the address you provide. The newsletter is delivered by Beehiiv, and your subscription is also subject to Beehiiv’s terms and privacy policy as our email provider.

You can unsubscribe at any time using the link in any email; we will stop sending. Sending frequency and content may change, and we may pause or discontinue the newsletter altogether. The newsletter is subject to the same disclaimers as the rest of the site.

What you send us

When you send an enquiry through the connect page or reply to an email, please keep it non-confidential. We may read, store and act on what you send, and we cannot treat unsolicited material as confidential or proprietary. Do not send trade secrets, personal data about other people, or anything covered by a confidentiality obligation. Ideas or suggestions you volunteer may be used without restriction or compensation. You are responsible for the accuracy of what you submit.

Third-party links and embedded content

The site links to and embeds material from other services — including YouTube and Spotify players on the podcast pages, event and publisher sites, and social profiles. We do not control that content and are not responsible for it, its availability, or the terms and privacy practices of the services providing it. A link is not an endorsement.

Disclaimer of warranties

The site is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or secure, or that the content is complete, current or accurate at any given moment.

Limitation of liability

To the fullest extent permitted by law, neither Paul W. Swaney III, Swaney Group Capital, nor their affiliates, officers, employees or contractors will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost business, lost data or business interruption, arising out of your use of — or inability to use — the site or its content, even if we have been advised that such damages are possible.

Our total liability for any claim relating to the site is limited to one hundred US dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Paul W. Swaney III and Swaney Group Capital from any claim, loss or expense (including reasonable legal fees) arising out of your misuse of the site, your breach of these terms, or your violation of the rights of anyone else.

Changes to these terms

We may update these terms as the site changes. The revised version is posted here with a new effective date, and it applies from the moment it is posted. If you keep using the site after an update, you accept the revised terms — so it is worth checking this page occasionally.

Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising from the site or these terms will be brought exclusively in the state or federal courts located in Pinellas County, Florida, and you consent to those courts’ jurisdiction. If any provision of these terms is found unenforceable, the rest stays in force.
